I had a personal injury at work and this is my story. My name is Michael K. Daniels and I’m a resident of Birmingham. For the past 10 years I’ve worked as a Warehouse Distribution Associate for a major electronics retailer. Safety on the job was always a priority, however after 10 years, safety became an afterthought during my day to day workload of activities. I was a satisfied employee, making good money, in a healthy and safe environment. I only wish I knew a little more about work injury claims.
The day of my accident was a typical day. I was in the back of the warehouse processing customer orders and assisting them with delivery of their products. I received a ticket for a 55” television which was on the third tier of the warehouse bay. I used the forklift to grab the pallet of televisions off the bay and drove it to where the customers were receiving them. As I was assisting the customer move his new television onto the back of his pickup truck I slipped and the box fell directly on my right leg. I was pinned in between his truck and the side of the warehouse dock. The origin of my personal injury compensation claim.
An ambulance was called and I was rushed to the emergency room. I had a compound fracture in my right leg along with severe ligament damage in my knee. The doctors explained that it would take several months of intense physical therapy to regain the ability to walk the same way I did before the accident. My wife was pregnant at the time with our third child. Being the sole income provider for the family, my first thoughts were how I was going to support the family.
After two days in the hospital, I was suited with a cast, given crutches, and discharged. I knew that since I was no longer working, the pay checks would stop. The first thing I did was speak with my supervisor who suggested filing a worker’s compensation claim. When I showed up at the main corporate office, they provided me with what seemed like an eternity of paperwork to fill out. I was given no guidance on what specifically needed to be filed and the process was lengthy and difficult.
After 6 weeks of being out of work with physical therapy, we received a letter that I will never forget. My employer was declining my workers compensation claim due to the fact that my paperwork was filled out incorrectly. I immediately contacted the human resources department and was told that based on the information I provided they could not accept my claim. I asked if I could re-file the paperwork and was told that it would not matter and I would again be rejected.
I did not know where to turn. It was at this point I started noticing advertisements for workmans comp lawyers. I made an appointment at one of the law firms and explained what happened. They assisted me with the proper way to file the claim and contact my company letting them know that I was now being represented by their firm. They also educated me on the subject of a no win no fee personal injury claim. They were well versed in the process and had the required knowledge of personal injury settlement amounts. Two weeks later my claim was settled and I was awarded the compensation I deserved.
There are thousands of people who experienced similar situations. I created this site to help people quickly find the best resources to assist them with their personal injury at work accident claims. Hopefully the information I provide will easily point you in the right direction and get you back on your feet fast!
